Statement on the Supreme Court decision in Trump v. Hawaii

We at Her Justice join immigrant communities, business leaders, and many people across the United States in expressing disappointment at this week’s Supreme Court decision in Trump v. Hawaii, one of the legal challenges to President Trump’s executive order that severely restricts travel from several majority Muslim countries to the United States.

Her Justice works every day to ensure that women living in poverty in New York City can get access to free legal help in order to build a better future for themselves, their children and our great city. We stand for equality of opportunity.

As lawyers, we have deep and abiding respect for the rule of law, but we are also cognizant of the human fallibility of those who create those rules.  We do not believe that the recent Supreme Court decision reflects the principles and values that we support as professionals and Americans. 

While the decision is a blow, it is not the end of the road. There have been moments of hope, as when a Federal Judge ordered the Trump administration to stop separating children from their parents at the border.

“As New Yorkers, we are confronted daily with the value of diversity and the possibility that America offers us to find unity across religious and racial difference. As lawyers, we believe that our laws should reflect the shared values and morality of our nation. As citizens, we are concerned that the law of the land, as it is being developed, is leading us in a direction that threatens to undermine those principles that make us most proud as New Yorkers, Americans, and lawyers. We recommit to our work to champion some of the most vulnerable among us, and work to ensure that our laws chart an aspirational path forward,” said Her Justice Executive Director Amy Barasch.

To learn immediately after the Trump v. Hawaii decision that the court’s “swing vote”, Justice Kennedy, will be retiring and giving the current administration another seat to fill only compounds our concern about the direction that the highest court in our land is taking. Now more than ever, it is up to lawyers to defend the constitution.

Her Justice will continue to support common sense immigration reforms, participate in community activities to protect the rights of immigrants and keep our clients and stakeholders informed of all developments in law and policy. We are committed to working with immigrant families in New York City so that we can all live in safety, stability and dignity.
