This training offers an introduction to the Family Court Act and Family Court practice for new attorneys or experienced attorneys who are taking their first pro bono custody, visitation, or family offense case. Her Justice provides an overview of the Family Court litigation process, from filing in the petition room to discovery to trial or settlement, as well as a review of relevant statutes and landmark cases, including recent case law development. Topics include: understanding the jurisdiction of the Family Court, the factors the Family Court considers in its custody and visitation determinations, elements of commonly-pled family offenses and aggravating circumstances, the use of forensics and court-ordered investigations and how to prepare your client for those processes, the role of the attorney for the child, and the effect of domestic violence on custody and visitation determinations.
Her Justice attorneys use real-life case examples and pleadings to illustrate the flow of a case and common challenges facing litigants and counsel. Attendees will walk away ready to commence their first custody, visitation, or family offense case in a Family Court in New York City, with special considerations for women in poverty.
